Stephen Thaler, a computer scientist, tried to obtain copyright protection in the US for an image of train tracks surrounded by purple flowers generated by software he created, named Creativity Machine. Together with this application for protection, Thaler identified the software as being the creator, claiming copyright for himself as the owner of the computer.
The application at issue was rejected and early in 2022, Thaler took legal action against this decision. According to the judgement of the court where this action was handled, “only artworks with human authors are protected by copyright.”
This decision also mentions that “human creativity is the sine qua non condition for Intellectual Property, even when it is channelled through new tools or new means of communication.”
